Without their assistance dog, a disabled person might struggle to visit your venue or enjoy the experience. Assistance dogs are highly trained and can safely accompany their owner in most creative and cultural experiences. You should have processes and facilities to support this. For example, a guide dog helps blind people navigate. A medical alert dog warns someone about medical events like seizures. Some dogs alert individuals to take their medication.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An assistance dog can come from a variety of breeds. They are often trained by their owner or a specialist organisation, like <a href=\"https:\/\/www.guidedogs.org.uk\/\">Guide Dogs<\/a>, <a href=\"https:\/\/www.hearingdogs.org.uk\/\">Hearing Dogs for Deaf People<\/a>, or <a href=\"https:\/\/dogsforautism.org.uk\/\">Dogs for Autism<\/a>. Each dog is trained to meet the specific needs of its owner.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.equalityhumanrights.com\/\">Equality and Human Rights Commission (EHRC)<\/a> says that assistance dogs:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>are highly trained<\/li>\n\n\n\n<li>are not likely to wander freely around the premises<\/li>\n\n\n\n<li>are likely to sit or lie quietly on the floor next to their owner<\/li>\n\n\n\n<li>are unlikely to foul in a public place<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This can guide your expectation for how a trained assistance dog should behave at your venue. Even well-trained dogs can get distracted at times. However, you should not expect them to show aggression or be untrained for toileting. Behaviours like barking, jumping up to their owner, or pulling on their lead may indicate alerts. These behaviours can signal an oncoming medical episode to their owner.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You may want to include the EHRC expectations in your assistance dog policy. This can help clarify the behaviour you expect from a trained assistance dog. If a dog acts in a way that doesn\u2019t meet these expectations, it might be appropriate to deny access or ask the dog to leave.<\/p>\n\n\n\n<h4 class=\"wp-block-ace-heading\">Legal context<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The <span data-definition=\"equality-act-2010\" data-definition-id=\"3611\" title=\"Equality Act (2010)\" data-definition-name=\"Equality Act (2010)\" class=\"ace-definition-inserter\"><\/span> defines <span data-definition=\"assistance-dogs\" data-definition-id=\"4209\" title=\"Assistance dogs\" data-definition-name=\"Assistance dogs\" class=\"ace-definition-inserter\"><\/span> (in relation to using transport and taxis) as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a dog trained to guide a blind person<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a dog trained to assist a deaf person<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a dog trained by a prescribed charity to assist a disabled person who has a disability that consists of epilepsy or otherwise affects the person\u2019s mobility, manual dexterity, physical coordination, or ability to lift, carry or otherwise move everyday objects<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a dog of a prescribed category which has been trained to assist a disabled person who has a disability (other than those listed above) of a prescribed kind<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In a legal context, you should think of assistance dogs in the same way as someone\u2019s wheelchair or white cane. Without these aids, individuals cannot visit your venue or enjoy experiences equally. Allowing someone to bring their assistance dog safely and comfortably is a <span data-definition=\"reasonable-adjustments-2\" data-definition-id=\"4237\" title=\"Reasonable adjustment\" data-definition-name=\"Reasonable adjustment\" class=\"ace-definition-inserter\"><\/span>.<\/p>\n\n\n\n<h4 class=\"wp-block-ace-heading\">Emotional support animals (ESAs)<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Emotional support dogs and other animals provide comfort by simply being there. Unlike assistance dogs, they do not require special training. The law does not specifically mention them, so you may not always have to allow these animals in your venue or event.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the law states you must make reasonable adjustments for disabled people. In some cases, allowing an <span data-definition=\"emotional-support-animals-esas\" data-definition-id=\"4211\" title=\"Emotional support animal (ESA)\" data-definition-name=\"Emotional support animal (ESA)\" class=\"ace-definition-inserter\"><\/span> could be a <span data-definition=\"reasonable-adjustments-2\" data-definition-id=\"4237\" title=\"Reasonable adjustment\" data-definition-name=\"Reasonable adjustment\" class=\"ace-definition-inserter\"><\/span>. Each request should be considered on its own merits.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When deciding if allowing an emotional support animal is a reasonable adjustment, consider:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>whether making the adjustment will remove or reduce the disadvantage someone is facing<\/li>\n\n\n\n<li>if it is practical to make the adjustment<\/li>\n\n\n\n<li>if it is affordable to make the adjustment<\/li>\n\n\n\n<li>if making the adjustment could harm the health and safety of others<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Note that trained psychiatric assistance dogs differ from emotional support animals. They should be treated like any other assistance dog as described above.<\/p>\n\n\n\n<h4 class=\"wp-block-ace-heading\">Identification<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\"><span title=\"Assistance dogs\" data-definition-name=\"Assistance dogs\" data-definition=\"assistance-dogs\" data-definition-id=\"4209\" class=\"ace-definition-inserter\"><\/span> usually wear a recognisable harness, jacket, lead slip, or bandana. For instance, <a href=\"https:\/\/www.guidedogs.org.uk\/\">Guide Dogs<\/a> have white harnesses with bright yellow stripes. <a href=\"https:\/\/www.hearingdogs.org.uk\/\">Hearing Dogs for Deaf People<\/a> wear burgundy jackets, while <a href=\"https:\/\/www.medicaldetectiondogs.org.uk\/\">Medical Detection Dogs<\/a> sport red jackets. However, there is no legal requirement for assistance dogs to wear these items, and some owners may choose not to.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dogs trained by organisations that are members of <a href=\"https:\/\/www.assistancedogs.org.uk\/\">Assistance Dogs UK<\/a> often carry an ID booklet. This booklet includes details about the dog and the training organisation. Some people might also use the Assistance Dogs International app on their phones to show their dog&#8217;s accreditation. Still, not every assistance dog comes from an accredited organisation, and not all owners carry ID. There is no legal requirement for this.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is no official registration process for every assistance dog in the UK. Therefore, you cannot ask for legal \u2018proof\u2019 from an assistance dog owner that applies to everyone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.assistancedogs.org.uk\/\">Assistance Dogs UK<\/a> advises treating each assistance dog owner as an individual. If someone claims they are disabled and their dog is a trained assistance dog, and its behaviour supports this, you should accept that.<\/p>\n\n\n\n<h4 class=\"wp-block-ace-heading\">Assistance dogs in training<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Part of training <span data-definition=\"assistance-dogs\" data-definition-id=\"4209\" title=\"Assistance dogs\" data-definition-name=\"Assistance dogs\" class=\"ace-definition-inserter\"><\/span> involves exposing them to a variety of environments. However, assistance dogs in training do not have the same legal rights as fully trained assistance dogs. This means you may not always have to allow them access. Still, many trainers and organisations depend on the goodwill of service providers and venues for access during training. You should consider when to allow or deny access for assistance dogs in training. Include this in your policy and your location access information.<\/p>\n\n\n\n<h4 class=\"wp-block-ace-heading\">Pre-visit information and assistance dog policies<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">It is important to provide clear information on your location access page about your approach to <span data-definition=\"assistance-dogs\" data-definition-id=\"4209\" title=\"Assistance dogs\" data-definition-name=\"Assistance dogs\" class=\"ace-definition-inserter\"><\/span>. Include what facilities you provide for them and their owners. This helps ease anxiety for assistance dog owners and reassures them that their needs will be met. For example, you should include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>your assistance dog policy or the section about assistance dogs in your access policy<\/li>\n\n\n\n<li>the facilities you can offer for assistance dogs, like dog mats and water bowls to borrow on request<\/li>\n\n\n\n<li>if there is an assistance dog <span title=\"Spending area\" data-definition-name=\"Spending area\" data-definition=\"spending-area\" data-definition-id=\"4214\" class=\"ace-definition-inserter\"><\/span> at your venue, see <a href=\"https:\/\/allin.online\/standard\/built-environment\/facilities\/assistance-animal-areas\/\">Built Environment 5.04 Assistance Animal Areas<\/a> for more guidance<\/li>\n\n\n\n<li>if you can look after assistance dogs while their owners attend an event or experience<\/li>\n\n\n\n<li>information about seats or areas that have space for assistance dogs to sit or lie down<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s essential to provide people with clear instructions on how to contact you. They may have questions or want to inform you about bringing their assistance dog to your venue. Offer several ways for them to reach out. This allows them to choose the method that works best for them. However, they do not have to.
